Works database

Rights and obligations for the use of the online works database

1. These Terms and Conditions of Use are supplemental to the provisions of the Rights Administration Agreement and General Terms and Conditions of Use and regulate your rights and obligations relating to the use of SUISA’s online works database.

By clicking the “Works Database” button and using the online database, you undertake to comply with the Rights Administration Agreement, the General Terms and Conditions of Use, and the below terms and conditions.

2. You have the non-exclusive and personal right to use the online works database to search for works and entitled parties.

Access is restricted to the following information:

  • In respect of authors’ own works, the works published by publishers, and the works in catalogues managed by a publisher: unrestricted access.
  • In respect of third-party works: original entitled parties only, without distribution key; SUISA is entitled to block access to such data at any time for data protection reasons.

3. Access is granted to the Administrator(s) of the account and to users with access rights to whom this service has been assigned. All such persons undertake to prevent access by unauthorised third parties. SUISA declines any liability for unauthorised access.

4. You may only use the retrieved data for your own purposes.

You must handle any retrieved data and information which does not concern you as confidential for an indefinite period of time. You may not disclose or make available such data and information to third parties, and you must safeguard the data and information against access by unauthorised third parties.

You must observe the applicable privacy policy and data protection requirements.

5. If SUISA establishes that these Terms and Conditions of Use have been breached, namely in the case of unauthorised access or non-compliance with confidentiality requirements, it may temporarily or permanently block access to the works database.

SUISA is entitled to supervise access to the system.

6. You are liable to SUISA for all direct and indirect damages (including court and legal fees) incurred by SUISA as a result of any infringement of these Terms and Conditions of Use.  As Administrator, you are liable for the acts and omissions of any persons, authorised or unauthorised, who access SUISA’s works database in the same way as for your own.

You undertake to hold SUISA, its sister societies and other persons fully harmless from any third party claims (including court and legal fees) arising from the infringement of these Terms and Conditions of Use by you or by any persons, authorised or unauthorised, accessing the account.

SUISA makes no warranties or representations as to the accuracy or up-to-dateness of the information made available in the works database. SUISA disclaims all liability in this regard.

7. SUISA stipulates the technical specifications and requirements that must be met on your side to use the system. Such specifications and requirements may be modified at any time.

8. As a rule, the database is accessible at all times. SUISA reserves the right to restrict, block or interrupt access temporarily if necessary for system maintenance purposes or for any other reason.

SUISA makes support available during customary office hours.

SUISA is responsible for systems maintenance and for monitoring its functionalities.

SUISA does not represent or warrant the permanent availability of the system or the security of data transmission. SUISA disclaims all liability for communications breakdowns, failures or disturbances and for data transmission.

9. SUISA is entitled to charge a cost contribution for the use of the works database. SUISA publishes the amount of the cost contribution and reserves the right to change it at any time.
