Publishing agreement

The model agreement is intended as a template for agreements between authors and publishers. Its purpose is to encourage discussion between the contractual parties on the contents of the agreement and thus further a relationship of trust between the author and the publisher.

The agreement is available in two versions: a template with the contractual text only and no comments, and a template with a commentary explaining the main provisions.
The model agreement can be used as it is, but it can also be amended. Please be aware that the agreement contains blank spaces where entries may or must be made:

  • Mandatory entries: Parties to the Contract (names and other information on the parties) Clauses 1.1, 1.4, 1.5, 5.2.1, 5.6.9
  • Optional entries: Clauses 1.2, 1.3, 2.1.1, 2.2.2, 2.2.7, 4.5, 5.5.3, 5.6.3, 7.3.2.

A model sub-publishing agreement has been prepared to match the model publishing agreement. If you are unsure about the provisions in the model agreements, please contact  publisher@suisa.ch.

The Swiss Music Publishers’ Association (www.svmv.ch )  offers its members a different model agreement.
