Authors’ rights remuneration for making online advertising campaigns available amounts to 2.15% of the online media budget. The accurate calculation of the remuneration shall be made on the basis of the actual budget for making the commercials available on the internet. In this context, the costs for the placement on third-party platforms or other websites must be specified. The licensing terms and conditions shall be in force from 01 May 2017. The licensing terms and conditions for online advertising campaigns are not subject to the tariff supervision by the Federal Arbitration Commission (ESchK).
Online tariffs can be freely negotiated between the parties; it does not have to be SUISA that is necessarily the party managing the copyright in musical works for online exploitations.
The Swiss Cooperative Society of Music Authors and Publishers represents the majority of significant composers of advertising music. On behalf and in the interest of these authors, SUISA sought a solution during the negotiations which guarantees composers a fair remuneration for the online advertising usage of their music, and is also easy to implement for all involved parties.
