Distribution Rules: Decision of the Federal Institute for Intellectual Property

The Federal Institute for Intellectual Property has approved the following amendment to SUISA's Distribution Rules:

"Change in the allocation of CT 3a tariff revenues / Amendment of point 5.5.2" published in the SHAB/FOSC on 19.08.2020.

The change was made following the elimination of former distribution category 2E (commercials on private radio stations). The relevant revenues are now allocated for 70% to distribution category 1E, and for 15% each to distribution categories 1A and 2A.  Since SUISA is required to manage the rights entrusted to it economically, and only 0.5% of its CT 3a audio revenue was allocated to the former distribution category 2E, these revenues are now allocated entirely to distribution category 1E.  This is also consistent with the principle that revenues without programme information should primarily be allocated to the distribution categories in which the same or similar music predominates.
