Basel Tattoo: SUISA Satisfied with Federal Supreme Court Ruling
In its Judgment of 19 March 2014, the Federal Supreme Court confirmed that Basel Tattoo is unequivocally a musical event. Overall, music plays a primary role in the individual performances. In its ruling, the Federal Supreme Court followed SUISA’s arguments.
For the right-holders of the music concerned, this is an important decision: as soon as the outstanding amounts for the festivals after 2009 have been paid by Basel Tattoo, SUISA will transfer the royalties to the composers for the performance of their musical works. Moreover, the classification followed by the Court establishes legal certainty for similar events in Switzerland. SUISA is satisfied with the judgment handed down by the Federal Supreme Court.
